Your legal entitlements upon retrenchment

Notice period

Under the Employment Act, minimum notice periods depend on your length of service:

Retrenchment benefit

The Employment Act does not mandate a specific retrenchment benefit formula. MOM's Tripartite Advisory recommends retrenchment benefit equivalent to 2 weeks' to 1 month's salary per year of service — but this is advisory, not legally mandated for employees with fewer than 2 years' service. Employees with at least 2 years of continuous service are legally entitled to retrenchment benefit under the EA. The Employment Claims Tribunal (ECT) resolves disputes about entitlements.

MOM notification requirements

Employers must notify MOM if retrenching 5 or more employees within any 6-month period. This notification triggers additional government support: MOM counselling, Careers Connect access, and SkillsFuture support for affected employees.

Immediate steps after retrenchment

  1. Collect your tax clearance if relevant (EP holders — employer must notify IRAS)

Work pass holders — EP cancellation and job search

If you are retrenched and hold an Employment Pass, your employer must cancel your EP within 1 week of your last day. MOM allows EP holders a short period to remain in Singapore while job-searching after EP cancellation — but you cannot legally work without a valid pass. Apply for a new EP through a new employer, or a Short-Term Visit Pass (STVP) to remain while searching. Starting work before a new pass is issued is a serious legal breach.
